FLASH REPORT: WCIRB: 40% Workers' Comp Rate Increase Likely... This is no April Fool's
joke. The Workers' Compensation Insurance Rating Bureau (WCIRB) Actuarial Committee just completed its review of its interpretation of California industry
experience. They conclude that California's workers' compensation advisory pure premium rates need to increase by nearly 40% -- 39.8% by one member's calculation.
U.S. Supreme Court Declines to Hear Workers Comp for Illegal Aliens Case... The U.S. Supreme
Court has refused to hear arguments whether an illegal alien should receive retroactively receive disability and compensation for work-related injuries. It is a
Louisiana case. The Supreme Court, as is typical, did not provide a reason, but its decision not to hear the case will leave the issue with each state. Many state
legislatures and courts have decided including California which allows illegal aliens to receive benefits. Some states do not so allow.

Small Businesses Deal with Disabled-Access Suits
San Francisco merchants, concerned about being sued for failing to provide access to disabled customers, met Tuesday
with city officials who soon will embark on a campaign to educate business owners about accessibility requirements and help forestall lawsuits that might put them
out of business.
Employment Practices Liability
Exempt vs Non-exempt:
Know Your Classifications... $113,788.80!
This is the amount a family-owned Bay Area restaurant was ordered by the DLSE to pay to a Sous Chef in unpaid overtime and missed meal periods, for being misclassified
as exempt...This Restaurant's recent experience should serve as an opportunity to evaluate the classification of your chefs before a claim is filed, especially
(as this experience demonstrates) because claims filed with the DLSE seem to tipped in the employee's favor.
